Vets File Class Action Lawsuit on PTSD Policy

Many veterans face the problem that their characterization of discharge disqualifies them from VA benefits. The characterizations often arise from a pattern of misconduct or misbehavior after serving in combat. In recent years the Department of Defense (DoD) has promulgated policies, instructions, and regulations pursuant to legislation that tries to protect veterans with PTSD from a misguided discharge. A class action lawsuit on PTSD policy seeks to apply these protections to vets discharged before the new policies took effect.

Unfortunately, the policies did not exist for Vietnam Veterans. That deficiency is what John Shepherd, Jr. is trying to fix. After receiving a Bronze Star with “V” device, he was discharged as part of a court-martial verdict. He received a diagnosis for PTSD after discharge, and the possibility exists that his behavior leading to the court-martial was substantially caused by his PTSD. The lawsuit addresses this question: should recently instituted policies intended to protect troops with PTSD be applied retroactively to other veterans? This class action lawsuit on PTSD policy could have far reaching effects for many veterans who were discharged prior to enactment of recent DoD regulations.
