Non-Hodgkin’s Lymphoma
What is Non-Hodgkin’s Lymphoma?
Non-Hodgkin’s lymphoma is a type of cancer of the lymph glands and other lymphatic tissue. Specifically, lymphatic tissue is found in the lymph nodes, spleen, and other organs of the immune system. Symptoms association with Non-Hodgkin’s include:
- Swollen lymph nodes
- Fever
- Night sweats
- Fatigue
- Weight loss
- Abdominal pain
- Chest pain
- Itchy skin
Presumptive Service Connection
The VA presumes that Non-Hodgkin’s lymphoma is related to a Veteran’s exposure to Agent Orange or other herbicides during military service, service in Vietnam, or the offshore waters of Vietnam during the Vietnam Era. Qualifying veterans do not have to prove a connection between their disease and service to be eligible for service connection.
Non-Hodgkin’s lymphoma is different from the other presumptive service conditions associated with herbicide exposure, which this condition there are multiple legal presumptions available:
- 38 CFR § 3.309(e): provides for the presumption of service connection for any diagnosis of Non-Hodgkin’s lymphoma, anytime that the disease manifests itself after service, as a result of exposure to herbicides and Agent Orange
- 38 CFR § 3.313: provides for the presumption of service connection for any diagnosis of Non-Hodgkin’s lymphoma, anytime that the disease manifests itself after service without reference to Agent Orange or herbicides
The VA does not require veterans to prove they are “boots on the ground” in Vietnam. Instead, they are only required to show that they had service in Vietnam.
How is Non-Hodgkin’s Lymphoma Rated?
The VA rates Non-Hodgkin’s lymphoma at a 100% rating when the disease is active or during a treatment phase. This rating continues beyond the completion of treatment for six months. At this point a new rating is determined by a C&P examination and based off of the residuals of the disease.
