VA Benefits for Peripheral Neuropathy From Agent Orange
Peripheral neuropathy results from damage to the peripheral nerves. Exposure to Agent Orange may cause this nerve damage.
The VA presumes service connection due to Agent Orange exposure is peripheral neuropathy and any veteran suffering peripheral neuropathy directly caused by exposure to the toxic herbicide Agent Orange could be eligible for VA Disability Compensation.
Establishing VA Disability
The VA presumes a service connection for peripheral neuropathy due to Agent Orange exposure if the veteran meets the below criteria.
- The VA only presumes service connection for this condition if it is early-onset, which means the veteran’s peripheral neuropathy must have manifested within a year of separating from service.
- The veteran’s peripheral neuropathy must have been at least 10% disabling within one year of discharge
If the veteran doesn’t qualify for presumptive service connection, they must meet the below criteria to receive VA disability benefits for this condition.
- The veteran has a current diagnosis from a medical provider.
- The veteran experienced an event, injury, or illness during their service.
- There is a nexus between the veteran’s in-service event and their diagnosis.
VA Disability Ratings For Peripheral Neuropathy
After the service connection has been established for this condition, the VA will then assign the veteran with a disability rating. This rating will determine how much compensation the veteran will receive monthly. Currently, there is no criteria for peripheral neuropathy therefore the VA uses the rating criteria for paralysis of the sciatic nerve.
The criteria that needs to be met for this condition are:
- 80% Complete, the foot dangles and drops, no active movement possible of muscles below the knee, flexion of knee weakened or lost.
- 60% Incomplete: Severe, with marked muscular atrophy
- 40% Moderately severe
- 20% Moderate
- 10% Mild
