Multiple Sclerosis
Multiple Sclerosis (MS) is a disease which impacts the central nervous system. The body’s immune system attacks the protective myelin sheath that covers and protects nerve fibers. This damage interferes with the transmission of nerve signals between the brain, spinal cord, and the rest of the body. Common signs and symptoms of MS include:
- Vision impairment
- Cognitive impairment
- Muscle stiffness and weakness
- Tingling and/or numbness
- Problems with sexual, bowel and bladder function
- Fatigue
- Loss of balance
There are also some less common symptoms of MS which include: tremors, headaches, seizures, and speech difficulties. Symptomology can widely range in severity, chronicity, and frequency.
How to Get a VA Disability Rating?
MS can be service-connected on a presumptive basis if it the symptoms are 10% disabling or more within seven years after separation from service. This means that veterans with symptoms of MS during their military service or within seven years of honorable discharge from the military, do not have to prove a link between their military service and MS.
If a veteran’s diagnosis for MS comes after seven years, they can still be service-connect for MS. They will need to provide a medical link between their time and service and a diagnosis of MS as the presumption of service connection will no longer apply.
How is it Rated?
If a service connection for MS is granted the VA will automatically assign a minimum rating of 30%. After assigning a 30% rating the VA will rate any residuals of the condition based on their own independent diagnostic codes.
